1. Who we are

ForeverFriday is operated by Victory Interactive Inc., [registered address] ("we", "us"). By creating an account, signing an order form or using the platform, the business you represent ("you") agrees to these terms. If you do not agree, do not use the service.

2. The service

ForeverFriday finds decision-makers from public sources, verifies their business e-mail addresses without writing to them, writes and sends plain-text e-mails from your own domain, and classifies and answers replies along the workflow you set. Features, limits and prices are those of your plan or order form.

3. Accounts

• The service is for businesses only, not for consumers.
• Keep your account details accurate and your sign-in credentials safe; you are responsible for what is done under your workspace.
• You decide who in your organisation has access and with which role.

4. You are the sender

Every e-mail the platform sends for you is sent in your name, from a domain you own. You are responsible for having a lawful basis to contact each recipient and for complying with the laws that apply to you and to them, including data protection and electronic marketing rules such as the GDPR, the ePrivacy rules and CAN-SPAM.

The platform honours opt-outs for you: a person who declines or asks to be removed is not written to again. You must not work around this.

5. Acceptable use

You must not use the service to:

• send unlawful, deceptive, harassing or misleading messages, or impersonate anyone;
• target people on the basis of sensitive characteristics, or contact children;
• send from domains you do not own or control;
• resell or share access, copy or scrape the platform, or interfere with its security or other customers.

6. Plans, credits and payment

Plans and credits are described on the pricing page or in your order form. A credit is used when the platform finds a person with a proved address. Fees are billed in advance through our payment provider, are exclusive of taxes, and are non-refundable except where the law requires otherwise. If a payment fails we may pause the service until it is settled. We will tell you before prices change for your next billing period.

7. Your data

You keep all rights in the data and content you bring or create in the platform. You give us the right to use it only to provide and improve the service for you. Where we process personal data on your behalf, our Data Processing Agreement applies.

The platform learns across customers in one narrow way: whether an address exists and how a company forms its addresses. That knowledge is shared so nobody pays twice to learn it; your prospects, campaigns and conversations are never shared with another customer.

8. Deliverability and results

We work to protect your sending reputation — verification before sending, warm-up, plain text, pacing — and we may pause sending when bounce or complaint rates put it at risk. We do not guarantee inbox placement, replies, meetings or revenue. Figures on our website are illustrations, not promises.

9. Third-party services

The service relies on third parties such as cloud hosting, e-mail delivery, payments, AI language models and public-data sources. Their availability is outside our control; we choose them with care and list those that process personal data in our DPA.

10. Our rights

The platform, its software and its design belong to Victory Interactive Inc. and its licensors. If you send us feedback, we may use it without obligation to you.

11. Warranties and liability

The service is provided "as is". To the extent the law allows, we exclude implied warranties, and our total liability for any claim is limited to the fees you paid us in the twelve months before it. Neither party is liable for indirect or consequential loss, lost profits or lost data, except where the law does not allow this to be excluded.

You will indemnify us against claims arising from the e-mails sent in your name, their content, or your breach of these terms or the law.

12. Ending the service

You may cancel at any time; the cancellation takes effect at the end of the billing period. We may suspend or end your access if you seriously breach these terms. After the end you may ask us for an export of your data within [30] days; after that we delete it, except what we must keep by law and the opt-out records we keep so that nobody is contacted again.

13. Changes and law

We may update these terms and will tell you in advance of material changes. These terms are governed by the laws of [jurisdiction], and the courts of [venue] have exclusive jurisdiction.
